Texas Construction Remodeling Mgt., Inc. (TCRMINC) Limited Life time Warranty warrants to the original purchaser, subject to the conditions and limitations set out below, the workmanship to free from defects at the time of completion of the work. TCRMINC further warrants the structure and all structural members to be free of defects not inherent in the quality requested by the Purchaser of a period of five (5) years from the date of completion of the work. Additionally, TCRMINC is committed to assisting its customers in maintaining the quality appearance of their project, present at the time of completion, for the life of their project as long as the original purchaser owns the home.. Therefore, TCRMINC will replace wood that goes bad if the customer meets the following conditions: a) Signs a satisfaction completion certificate at the end of the job; b) Applies a n approved penetrating oil base sealer to all exposed wood surfaces within the first 30 days following the completion of the work; and continues to do so as needed to protect the surfaces from the elements. c) Agrees to pay to TCRMINC a reasonable service charge. TCRMINC makes no other warranty, representation or guaranty, whether expressed or implied, that extended beyond the scope of this limited warranty, including, without limitation the implied warranty of merchantability or fitness for any particular purpose. All warranties under the agreement between TCRMINC and purchaser become valid and enforceable only upon Purchaser's full and timely payment of the Total Sales Price and compliance with all terms and conditions of the agreement between TCRMINC and Purchaser. It is a fact of nature that no two trees are alike and therefore no two pieces of wood, even those from the same tree, are the same. These differences in natural color and grain, treated and non-treated materials, mean that each piece may respond differently to the elements. This is the beauty and nature of wood. This warranty does not apply to any such differences in appearance. In addition, any finish will exhibit color changes over time when exposed to different types of light and environments. This process will be accelerated by factors such as fluorescent light, direct sunlight, cigarette/cigar smoke and certain household cleaners. Likewise, synthetically made materials will react differently when exposed to different types of light and environments. Texas Construction Remodeling Mgt. Inc. has no control over those factors or the changes in appearance caused by those factors and any such changes in appearance are not covered by this warranty. This warranty is limited to residential settings. labor, installation and shipping costs are not covered by this warranty. TCRMINC’S sole responsibility under this warranty shall be to either repair or replace the product, at the sole option of been subject to misuse, modification, neglect, accident, tampering or any event other than ordinary use. This warranty does not cover damage caused by, but not limited to, fire, flood, acts of nature and other factors which are beyond the reasonable control of TCRMINC.. All claims must be made within five days of installation. Any product claimed to be of defective workmanship or material must be returned for our inspection at our request. Service orders and material orders will be issued subject to our inspection. No returns will be accepted without authorization TCRMINC. This warranty requires that the purchaser exercise normal maintenance care. This warranty is void if the product has been abused tampered, altered, in any way. DO NOT the builders or workers without notifying us first for authorization. We will do everything possible to quickly rectify any problems that may arise. We are, as we have been since 2007, dedicated to customer satisfaction. TCRMINC inc. shall not be liable, in any event, or any loss or damages of any kind, including, but not limited to any indirect, special, or consequential damages arising from the use of this product by any person. some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you. This limited warranty is in lieu of all other warranties, express or implied, including but not limited to any warranty of merchantability or fitness for a particular purpose, all of such express or implied warranties being hereby expressly disclaimed and denied. This warranty gives you specific legal rights, and you may also have other rights, which vary, from state to state. Texas Construction Remodeling Mgt., Inc. reserves the right to add, change or delete material specifications in conjunction with their continuous product development program. Claims Procedure: All claims for defective goods must be submitted to Texas Construction Remodeling Mgt., Inc. in writing and must include a dated copy of the original retail sales agreement and specify the nature of the defects. Texas Construction Remodeling Mgt., Inc. will arrange an opportunity for its duly authorized personnel to inspect, and will then elect to either repair or replace the defective cabinet or its defective component part. All claims must be mailed to the following address: Structural includes the following: All sub-frame components including: Joists, Joists hangers, Rim boards, Ledger Boards, Posts/Legs and concrete piers. Texas Construction Remodeling Mgt., Inc. warrants all cosmetic items to be free from defects including excessive warping, breaking, knot holes, looseness, and stains, (excluding damage from a natural disaster or “act of god” and normal checking and cracking less than ½” inch) for a period of sixty days following the date of completion. If excessive cracking, breaking, knot holes, looseness, or stains, of any cosmetic items occur within a sixty day period following the date of completion, Texas Construction Remodeling Mgt., Inc. will replace or repair at no labor cost (materials will be at owners cost.) Cosmetic items include the following: All generally exposed to the public items including: top rails, deck boards (flooring), spindles, wrap boards, and any other items determined to be a non-structural nature. Notice Concerning pressure treated projects: Due to the nature of pressure treated lumber to warp and crack, all CCA, Natural Select, or other pressure treated decks have no cosmetic warranty, however, the structural warranty fully applies. Texas Construction Remodeling Mgt., Inc. does not recommend the use of pressure treated lumber for anything other than the sub-structure of the deck. Note: Regarding 4x4 and 6x6 in rough, smooth cedar and pressure treated post and beams. As these materials dry out they will experience what is know as “checking” which is a part of the normal drying process. During this process cracks will form, sometimes up to ¼ inch across. This is a normal condition of the lumber and does not affect the integrity or the structure. “Checking” in not covered under the Texas Construction Remodeling Mgt., Inc. structural or cosmetic warranty.
